Terms of Service and Sale

These terms govern access to the MomentCut service and the purchase of paid subscriptions. By creating an account or using the service, you accept them. The French version prevails in case of discrepancy.
1. Service provider
The MomentCut service (the “Service”), available at https://momentcut.co, is published by:

2. Purpose of the Service
MomentCut is online software (SaaS) that generates short clips from long videos: automatic transcription, AI-assisted selection of highlights, captions, reframing and export of video files. AI output (chosen moments, titles, descriptions, hashtags) consists of suggestions to review: you remain responsible for what you publish.
3. Account
Using the Service requires an account, created from an e-mail address and a sign-in link sent by e-mail (no password). You must be of legal age or have your legal guardian’s permission, provide a valid e-mail address and keep your access confidential. Accounts are personal; you are responsible for activity carried out with yours.
4. Plans and prices
- Free: 15 minutes of source video, once per e-mail address, 3 exports, MomentCut watermark on clips. Deleting an account and creating a new one with the same address does not grant those minutes again.
- Starter: US$9.99 or €9.99 per month excluding tax, 100 minutes of source video per month, exports without watermark.
- Creator: US$19.99 or €19.99 per month excluding tax, 300 minutes of source video per month, exports without watermark.
- Minute packs (for Starter and Creator subscribers): 60 minutes for US$9.99 or €9.99, 200 minutes for US$27.99 or €27.99, excluding tax. One-time payment, no subscription and no renewal.
Prices are shown excluding tax, in euros (EUR) for customers located in Europe and in US dollars (USD) elsewhere; applicable taxes (VAT or equivalent) are calculated and displayed at checkout according to your country. Minute quotas relate to the duration of the videos analyzed and reset with each billing period, without carry-over. Current plan details are on the Pricing page.
5. Payment through Paddle
Orders are processed by our payment partner Paddle.com, which acts as reseller (“Merchant of Record”) of the Service: Paddle processes payments, issues invoices and handles refunds. Your purchase contract for the subscription is concluded with Paddle, under the buyer terms Paddle shows you at checkout, in addition to these terms which govern use of the Service. Your billing data is processed by Paddle under its own privacy policy.
6. Subscription, renewal and cancellation
Starter and Creator are monthly subscriptions that renew automatically at each billing date, at the current price, until cancelled. You can cancel at any time from your account: the “Manage subscription” button in the client area opens Paddle’s customer portal, where cancellation is done directly. You can also write to us at contact@momentcut.co from your account address. Either way, cancellation takes effect at the end of the current, already paid period, and no further charge is made. The Free plan requires neither a card nor a commitment. Refund conditions are described in the Refund Policy.
As the Service starts as soon as you subscribe, your 14-day withdrawal right (Article L221-28 of the French Consumer Code) is exercised under the terms of the Refund Policy.
6a. Minute packs and plan changes
A minute pack is a one-time purchase that adds minutes of source video to your account. It creates no subscription and is never renewed automatically. Those minutes are used after your plan’s monthly quota: the quota is always consumed first, and the purchased balance is only drawn on once the quota is exhausted. Purchased minutes do not expire and carry over from one billing period to the next. They are neither transferable nor convertible into money, and are not refunded when a subscription is cancelled. If you delete your account, any unused balance is permanently lost and is not refunded: deleting is an erasure request, not a cancellation request.
Under article L221-28 13° of the French Consumer Code, buying a pack concerns digital content supplied immediately: by confirming payment you expressly request that immediate supply and acknowledge that you lose your fourteen-day withdrawal right on that pack as soon as the minutes are credited to your account. As long as no minute of the pack has been consumed, we nonetheless accept a full refund on request within fourteen days, as stated in the Refund Policy.
Moving from Starter to Creator is done from your account and takes effect immediately. Paddle charges the difference between the two plans straight away, calculated pro rata for the time remaining in the period you already paid for, then applies the Creator rate at each following renewal. The monthly quota becomes the Creator quota for the current period, without re-crediting minutes already used.
7. User content
You keep full ownership of the videos you upload and of the clips, captions and texts generated from them. You grant the provider a limited, non-exclusive, revocable licence strictly necessary to host, transcribe, analyze, transform and return this content to you.
You warrant that you hold all necessary rights (copyright, related rights, image rights, permissions from the people filmed) on uploaded videos, including when a video is imported from a link (YouTube, Vimeo or an online file). Link import may only be used for videos you authored or are authorized to use; it must not circumvent the terms of the originating platform. You indemnify the provider against third-party claims related to your content.
8. Prohibited uses
You may not use the Service to: upload content you do not have the rights to; process unlawful or hateful content, sexual content involving minors, content inciting violence or infringing others’ privacy; produce misleading content that depicts a real person falsely; disrupt the Service (abusive automated access, quota circumvention, attempts to access other users’ data); or resell the Service without written agreement.
9. Intellectual property of the Service
The software, the MomentCut brand, the interface and the documentation remain the property of the provider or its licensors. These terms only grant you a personal, non-exclusive, non-transferable right to use the Service for the duration of your subscription.
10. Availability, suspension and termination
The Service is provided “as is” and may evolve. The provider strives for continuous availability but does not guarantee the absence of interruptions (maintenance, outage at a subcontractor, unavailability of an AI model). The provider may suspend or close an account, after e-mail notice except in urgent cases, for breach of these terms, non-payment or clearly abusive use.
You can delete your account at any time from the “My account” section of the client area: deletion is immediate and permanent, it erases your videos, projects, transcripts, clips and exported files, and a confirmation e-mail is sent to you. If a subscription is running, cancel it first (article 6): deleting the account does not stop the subscription. The same section lets you download all of your data before leaving. You can also write to us at contact@momentcut.co from your account address. An account left without any activity for 24 months is deleted after a warning e-mail sent 30 days beforehand. 11. Limitation of liability
To the extent permitted by law, the provider’s liability under the Service is limited to direct, proven damages and cannot exceed the amount you paid during the last twelve months. The provider is not liable for data loss due to the expiry of exported files (downloadable for 7 days) or of source videos unchanged for 30 days, nor for your use of published clips. Nothing in these terms limits mandatory consumer rights or liability for gross negligence or wilful misconduct.
12. Changes
The provider may change these terms or the prices. Material changes are announced by e-mail or on the site at least 30 days before they take effect; price changes apply from the billing period following that notice. If you do not accept the new terms, you may cancel before they take effect.
13. Governing law and mediation
These terms are governed by French law. For any dispute, please write to us first at contact@momentcut.co. Under Articles L611-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge; the appointed mediator’s details will be listed here before commercial launch: [MÉDIATEUR À COMPLÉTER]. The European online dispute resolution platform is available at ec.europa.eu/consumers/odr. Failing an amicable settlement, French courts have jurisdiction, subject to the protective rules applicable to consumers residing in another country.
